Abstract
Road safety is a matter of worldwide interest for all factors with direct and indirect duties in the field of road security and safety, as well as for all citizens, whether they are car drivers or different types of road users, each of them having the possibility to collectively and individually contribute to safer traffic. One of the fundamental principles of law is that of liability. Legal liability in matters of road safety is an absolutely fundamental institution of law, also representing a basic component of the entire law system. The frequency and gravity of offences, as well as their negative consequences on social balance and legal order generally force the lawmaker to clearly establish the liability for these offences and to promptly apply the necessary sanctions. It is within this general framework that legal liability and road safety play an important role since they represent the ensemble of all actions and measures meant to improve human behaviour, vehicles and road infrastructure, which should lead to the safe traffic of all categories of public road users by reducing the risk of becoming involved in road accidents and by diminishing their consequences.
